California Wants to Silence Informed Consent
URGENT CALL FOR GOVERNOR NEWSOM TO VETO AB 2098
Because EACH DAY, EACH HOUR matters, this is a plea to Share far and wide that if this particular bill passes with Governor Newsom’s signature, the practice of medicine will forever change from what Hippocrates and all physicians have done since the advent of medical care:
AB 2098, sitting on the Governor’s desk, will silence every doctor’s ability to provide proper and ethical Informed Consent.
I don’t know why the lawyers didn’t look at this from a Constitutional standpoint, but I am sure they are waiting for this to try to pass - and then they will enter into a huge legal battle with an onslaught of lawsuits that will defend the Constitution.

But this is more than just that. It is the thought that the government thinks it can stand in the office with me and my patient that has such enormous potential to escalate down a slippery slope: when would it stop?
Medical organizations are coming together from the left and the right, as well as the middle? Why? Because if this bill passes, it will be ILLEGAL for ALL doctors to discuss the wide variety of issues surrounding ANY procedure, medication, or intervention.
It would require all doctors to simply spew out the government’s party line, without taking into consideration the particular patient. This violates my Hippocratic Oath to “Do No Harm”.
It ties my hands and makes me a robot.
What is Informed Consent?
Informed Consent is a relationship and legal issue whereby a doctor is required, due to the Standard of Care, to give each patient an explanation of any procedure, medication, or intervention like a surgery so that the patient understands the potential harms and benefits.
Proper Informed Consent Requirements: RISKS, BENEFITS, and ALTERNATIVES
The general risks and benefits are required to be discussed;
Specific explanations of the particular risk to the individual patient is required to be discussed.
Alternatives to the procedure must be discussed, as well as their risks and benefits.
It is the Standard of Care to provide Informed Consent.
We learned Informed Consent in medical school, we performed it in residency and internship, perfected it in Fellowship, and have been practicing it for decades.
Ultimately, the patient, in discussion with their doctor, decides how to proceed.
Doctors have been sued for not providing Informed Consent.

AB 2098 would classify “misinformation” or “disinformation” related to the SARS-CoV-2 which is not defined - as “unprofessional conduct”. Would it stop there? Or should it go there at all?

What Happens if Gov. Newsom Vetoes AB 2098?
Governor Newsom may have just 12 days to either:
1) Sign;
2) Approve without signing; or
3) Veto
If AB 2098 Passes: If 1 or 2 happens, the bill goes to the Secretary of State to be chaptered or brought into fruition.
If AB 2098 is Vetoed: If the Governor listens to the voters and vetoes the bill, each house would have to have a two-thirds vote to actually override his veto. If vetoes, we will know this because he would release a video of explanation - it would be posted directly from the Office of the Governor.
