AB 2098, codified at Cal. Bus. & Prof. Code § 2270, took effect on January 1, 2023. The statute provides that “[i]t shall constitute unprofessional conduct for a physician and4 surgeon to disseminate misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines.” Cal. Bus. & Prof. Code § 2270(a) (emphasis added).

Here is the Court Order:

“The physician plaintiffs have therefore established a concrete plan to violate the challenged law”:

“(in the context of a pre-enforcement challenge on First Amendment grounds, a plaintiff “need only demonstrate that a threat of potential enforcement will cause him to self censor”).”
